EnhancaCursor License Agreement

1. THIS AGREEMENT:
This license agreement is a legal agreement between you the end user (either as an individual or an entity) herein after referred to as the "user" or "LICENSEE" and the authors of EnhancaCursor herein after referred to as the authors or "ZOMINA". This software and any of its supporting documentation are herein after referred to as the "product", “SOFTWARE PRODUCT”, “software” , “program”, or EnhancaCursor,.
By installing or using the product, you indicate your complete and unconditional acceptance of these terms and conditions. If you do not agree to the terms and conditions of this agreement promptly remove the product from your computer.
The authors reserves the right, at their discretion, to change or modify all or any part of this Agreement at any time, effective immediately upon notice published on http://www.EnhancaCursor.com. Your continued use of the product constitutes your binding acceptance of these terms and conditions, including any changes or modifications made by the authors as permitted above. If at any time the terms and conditions of this Agreement are no longer acceptable to you, you should immediately cease all use of the product.
ZOMINA hereby grants to LICENSEE nonexclusive rights to use the product from the Effective Date without any rights whatsoever to redistribute the product, under the terms and conditions of this agreement. ZOMINA retains all ownership rights in the SOFTWARE PRODUCT, including patent rights, copyrights, and licensing rights. No rights, express or implied, for use other than specified in this agreement are transferred.
When the software is used for personal purposes, the LICENSEE agrees that a single registration code must be purchased and can be used for up to four computers within the LICENSEE household that are used exclusively for personal use. When the software is used on business computers or when the software is used for business purposes, the LICENSEE agrees that a separate registration code or license must be purchased for each LICENSEE computer. LICENSEE agrees to save the registration key in a secure place and not to distribute the registration key. If the registration key provided to the LICENSEE is discovered in a public place, LICENSEE agrees that the registration key will be disabled and LICENSEE may be held legally responsible. If LICENSEE loses registration key, LICENSEE recognizes that ZOMINA is under no obligation to provide the lost registration key or a new registration key. LICENSEE further agrees only to use a registration key explicitly granted to him/her and supplied by ZOMINA.
The LICENSEE agrees not to reverse engineer, decompile, disassemble, or distribute the SOFTWARE PRODUCT, except and only to the extent that such activity is expressly permitted by applicable law notwithstanding this limitation.
2. ACCEPTABLE USE POLICY:
THIS PRODUCT MAY BE USED FOR LAWFULL PURPOSES ONLY.
3. LIMITED WARRANTY:
THIS PROGRAM AND ACCOMPANYING WRITTEN MATERIALS ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. NEITHER THE AUTHOR NOR ANYONE ELSE WHO HAS BEEN INVOLVED IN THE CREATION, PRODUCTION, OR DELIVERY OF THIS PRODUCT SHALL BE LIABLE FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, OR INCIDENTAL DAMAGES ARISING OUT OF THE USE OR INABILITY TO USE SUCH PRODUCT EVEN IF THE AUTHOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THIS INCLUDES BUT IS NOT EXCLUSIVE TO THE LOSS OF DATA OR DAMAGE TO ANY EQUIPMENT.
5. PRODUCT DEMONSTRATION
You are entitled to download this product and use it for a trial period. The period of this trial and the limitations of the product during this time may be subject to change by the authors without prior notice. Once this trial period has expired you agree to either (a) Uninstall the software or (b) purchase a registration key to convert the demonstration program into a fully registered copy of the product. Following clearance of payment, you become a registered owner of this product. By registering this program, you declare the product to be fit for your purposes.
6. A REFUND POLICY.
A refund is available for the downloaded version of this product providing the request for a refund is received by the authors within 30 days of having placed an order for the product. The authors retain the right to withhold a refund at their discretion. Having received a refund, you must uninstall the product from your computer. You also agree not to reinstall the product without placing another order for the product. The CD version of this product, once opened cannot be refunded. However, a defective CD can be exchanged for a non-defective copy of the product.
7. PRIVACY
If you register the demo version of this product your e-mail address may be kept by the authors. Zomina LLC will not willfully distribute your information to any third parties. Your e-mail address will be used solely to notify you of relevant company and software information. If this policy changes, you will be notified immediately. You can notify Zomina LLC at anytime and we WILL stop sending you updates. You may request to be removed from this mailing list at any time by contacting the authors at support@EnhancaCursor.com
